The person making the turn. The person going STRAIGHT still have right of way. You only make the turn when it is SAFE to do so. The exception would be that you made the turn when it was safe, and the other driver was REALLY speeding so you could not have predicted the car going straight would be there as you crossed.

But that would be hard to prove.

good Luck...

YOU ARE!
Reply:I agree with the 1st poster. Unless he was going predictable speed and then sped up before it was too late for you? See if the intersection has cameras -- some do.

EDIT: I was told that yellow means "clear the intersection". However, if you can't do that safely, you are supposed to go through.

So, since you were turning left, you were most likely in the intersection when the light turned yellow. Therefore, it was your obligation to clear it. If the other guy sped up from a safe speed, then I would say he was at fault, because he was able to stop safely but chose not to.

If that's true about the other guy...
Reply:Red = Stop

Amber = Stop

Green = Proceed only if safe to do so.
Reply:THE PERSON TURNING LEFT IS ALWAYS AT FAULT. YOU ARE HAVING TO CROSS THRU TRAFFIC TO GET WHERE YOU ARE GOING SO IT WOULD BE YOUR FAULT.
Reply:You are at fault. The person making the turn failed to yield.
Reply:They are partially at fault for trying to speed through a yellow light, but unless you actually had a green turn arrow, you need to yield to oncoming traffic before you turn. By failing to do so, you will shoulder most of the blame.
